the nation’s unofficial marijuana
smoking holiday,
weed has been a part of
our culture for decades but it wasn’t
until Washington and Colorado voted in
2012 to legalize recreational use that
members of Congress really started
trying to figure out how to address the
disparity between state and federal laws.
Today 66 percent of the American public
supports legalizing recreational
marijuana use but that hasn’t fully
translated into medical or recreational
bills gaining enough traction in
Congress to become law.
BLUMENAUER: Now is the time
for us to move forward we have a
bipartisan cannabis caucus.
SHUTT: So the Cannabis Caucus right now is roughly four lawmakers
it’s Earl Blumenauer, Don Young,
Barbara Lee and David Joyce
They are hoping to put forward some
common-sense bipartisan bills that can
address disparity in state and federal
law.
There are some issues with the tax
code where legal marijuana dispensaries
in line with state laws are not allowed
to deduct business related expenses on
their taxes the way non-marijuana
businesses are.
At the federal level
marijuana is considered a Schedule one
substance that means that it’s supposed
to have no medical use whatsoever and be
highly addictive which is something that
over time a lot of people have felt
doesn’t necessarily apply to cannabis
GAETZ: I had hoped that at our one of our initial
meetings we would have been giving
powers back to the states in the form of
removing cannabis from the list of
schedule 1 drugs I think the committee
would be very favorable to that if we
were any more favorable we might have to
start our meetings with the Grateful
Dead
SHUTT: One of the reasons that medical
marijuana dispensaries have been
protected is that since 2014 there’s
been a paragraph inserted into the
Department of Justice’s funding bill
every year and says they aren’t allowed
to spend any money interfering with
dispensaries that are in line with their
state medical marijuana laws there’s
some hope that during this Congress the
word medical might be able to be removed
from that section and so that would
provide some protections from
recreational or adult use dispensaries
as well.
There’s also some incentive for
more left-leaning Democrats to try to
advance legislation that would legalize
marijuana
HOST: You ever smoked?
HARRIS: I have. And I inhaled. I did inhale.
It was a long time ago.
SHUTT: But that’s not likely to get
bipartisan support in the Republican Senate.
There are several pieces of
legislation already introduced in the
116th Congress one of the ones that got
a lot of headlines is HR 420 and S 420
Those bills would overhaul the way the
federal government looks at marijuana
Former Deputy Attorney General James
Cole issued a memo in 2013 that outlined
a few ways that federal prosecutors
could determine whether or not they
should bring cases into the court system
COLE: And it also notes that we will continue
to rely on state and local authorities
to effectively enforce their own drug
laws as we work together to protect our
communities
SHUTT: Originally Attorney General
Jeff Sessions tried to rescind that Cole
memo which could have opened up
dispensaries to raids from federal law
enforcement and prosecution but Senator
Cory Gardner stepped in and threatened
to block confirmation of federal judges
on the Senate floor unless sessions
backed off
The new Attorney General
William Barr has said that he doesn’t
plan to change guidance on the Cole memo
at all but that he really wants Congress
to try to get some uniformity between
these state and federal laws.
Former Republican House Speaker John Boehner
is one of the more recent GOP
converts to marijuana legalization
efforts he’s obviously well known for
smoking cigarettes but so far he has not
said that he has ever actually smoked
and inhaled marijuana.
